Gifta Terms of Service

The terms that govern access to Gifta's current Dreamboard website platform and related services.

1. Introduction

These Terms of Service ("Terms") govern your access to and use of the Gifta Platform and related services provided by Gifta (Pty) Ltd, registration number 2026/260556/07 ("Gifta", "we", "us", or "our").

By creating an account, creating a Dreamboard, using a public Dreamboard page, or otherwise using the Platform, you agree to these Terms.

2. About Gifta

Gifta is a Dreamboard and pooled-gifting platform. The current live Platform allows users to:

  • create and manage Dreamboards;
  • share Dreamboards with other people;
  • display Dreamboard content publicly where a host chooses to publish it;
  • configure payout details for a Dreamboard; and
  • receive communications and service messages relating to the Platform.

Gifta currently offers live guest checkout on public Dreamboard contribution pages through Peach Payments. Additional review disclosures, provider requirements, and payment confirmations may apply before a contributor completes card entry.

3. Eligibility And Accounts

You may only use the Platform if you have legal capacity to enter into a binding agreement, or if you are using the Platform with lawful authority and under required supervision.

You are responsible for:

  • providing accurate account information;
  • keeping your information up to date;
  • maintaining the confidentiality of your sign-in methods; and
  • all activity that occurs through your account, except where caused by Gifta or its providers.

4. Dreamboard Content And Host Responsibilities

If you create a Dreamboard, you are responsible for the information you submit, including child or recipient information, photos, descriptions, dates, and payout details.

You must only submit information that:

  • is accurate;
  • you are lawfully entitled to provide;
  • does not infringe another person's rights; and
  • does not breach any law or these Terms.

If you create a Dreamboard for a child or include information about a child, you confirm that you are the parent or legal guardian, or that you otherwise have lawful authority to provide that information for the relevant purpose.

5. Acceptable Use

You may not use the Platform to:

  • break the law or help someone else do so;
  • impersonate another person or misrepresent your authority;
  • submit false, misleading, or fraudulent information;
  • use the Platform for money laundering, fraud, abuse, or prohibited transactions;
  • interfere with the operation or security of the Platform;
  • scrape, reverse-engineer, or attack the Platform except where expressly allowed by law; or
  • upload or publish content that is unlawful, infringing, abusive, defamatory, or harmful.

Gifta may suspend, limit, or terminate access where Gifta reasonably suspects prohibited conduct, security risk, fraud, abuse, or breach of these Terms.

6. Payout Information

Hosts may be asked to provide payout details for a Dreamboard, including bank-account details or Karri card details.

You are responsible for ensuring that the payout details you provide are accurate and belong to the person lawfully entitled to receive the payout.

Gifta may delay, limit, review, or refuse payout-related actions where reasonably necessary for security, fraud prevention, legal compliance, or operational integrity.

7. Live Guest Checkout

Public Dreamboard contribution pages may offer live guest checkout through Peach Payments.

When live checkout is available for a Dreamboard:

  • contributors may review the payment summary, disclosures, and terms before card entry;
  • payment details are submitted through Peach Payments' secure checkout surface rather than directly into Gifta; and
  • a contribution is only recorded after Gifta receives payment confirmation through the relevant provider-backed flow.

Gifta may still pause, limit, or disable checkout for a Dreamboard or for the Platform generally where reasonably necessary for security, fraud prevention, provider issues, legal compliance, or operational integrity.

8. Contribution Finality, Reversals And Disputes

Contributions made through live guest checkout are generally final once they have been successfully authorised, processed, and credited to the relevant Dreamboard.

Gifta does not offer routine discretionary refunds of completed contributions.

If you want to ask for money back after a completed contribution, you should contact the Dreamboard host first. Any goodwill return of funds is a matter between the contributor and the host unless Gifta separately agrees to assist.

Gifta may, but is not obliged to, assist with a reversal, refund, hold, or other payment correction where reasonably necessary or permitted, including for duplicate payments, unauthorised activity, fraud, manifest error, provider or scheme requirements, legal compliance, or where applicable law requires a remedy.

Once contributed funds have been settled onward, released, or paid out through the relevant payout flow, Gifta may be unable to reverse the original payment-method transaction.

If Gifta has already released or paid out related Dreamboard funds and a contribution is later reversed, charged back, clawed back, or otherwise corrected through the relevant payment or payout flow, Gifta may delay or reduce later payouts, set the amount off against funds otherwise due to the host, or require the host to repay the relevant amount and any associated external fees or penalties where reasonably necessary or permitted.

Payment disputes or chargebacks must generally be raised through the payer's bank or payment provider and will be handled under the applicable provider and card-scheme rules.

Nothing in these Terms limits any rights that cannot lawfully be excluded or restricted.

9. Communications

Gifta may send service-related communications relating to your account, Dreamboards, security, or Platform operations.

Where lawful and available, Gifta may also support communications tooling such as WhatsApp or email, but Gifta does not guarantee the availability, timing, or delivery of third-party communications channels.

10. Intellectual Property

Gifta and its licensors own or control the intellectual-property rights in the Platform, excluding content lawfully submitted by users.

Gifta grants you a limited, revocable, non-exclusive, non-transferable right to use the Platform for its intended purpose, subject to these Terms.

11. Suspension And Termination

Gifta may suspend, restrict, or terminate your access to the Platform where reasonably necessary for:

  • breach of these Terms;
  • security, fraud, or abuse concerns;
  • legal or regulatory compliance; or
  • operational maintenance or risk management.

You may stop using the Platform at any time.

12. Disclaimers

The Platform is provided on an "as is" and "as available" basis, subject to applicable law.

To the fullest extent permitted by law, Gifta does not guarantee that:

  • the Platform will always be available, uninterrupted, or error-free;
  • any communication channel or third-party integration will always function;
  • any current or future payment, payout, or provider surface will always remain available on any specific timeline; or
  • third-party services will remain available or unchanged.

13. Limitation Of Liability

To the fullest extent permitted by law, Gifta will not be liable for indirect, incidental, special, consequential, or punitive loss, or for loss of profits, revenue, business, goodwill, or data, arising from or related to your use of the Platform.

Nothing in these Terms excludes or limits liability where such exclusion or limitation is not permitted by law.

14. Indemnity

You agree to indemnify and hold Gifta harmless against losses, claims, damages, liabilities, and costs arising from your breach of these Terms, your unlawful use of the Platform, or your submission of information or content without lawful authority.

15. Governing Law

These Terms are governed by the laws of South Africa.

16. Changes To These Terms

Gifta may update these Terms from time to time. Updated versions will be posted on the Platform with a revised effective date. Material changes may also be communicated by email, in-product notice, or another appropriate method.
